This is along the lines of what my response was going to be. For something like murder, no, I don't understand the purpose of differentiating between hate and non-hate crimes. I think it would be more efficient to just call murder--murder and you have the only possibilities for a punishment be imprisonment for the rest of a person's natural life, or the death penalty. I'm not saying that we should get rid of second-degree or third-degree murder (and the lesser punishments associated therewith) just that First Degree murder is First Degree murder regardless of underlying motivations. The deceased certainly doesn't care if it's charged as a hate crime or not; they're too busy being dead. RXWine points out that some crimes have can have an element of hate to them by which they should be treated differently, and I agree with that perspective. Property crimes (such as the one mentioned), simple assault, battery, arson...I think there should be the potential for more lengthy punishments for those sorts of crimes if there is a provable element of (racial, cultural or religious) hate to them. I look at the years leading up to the publication of 1984 and it occurs to me that we may well have been ill-taught on this novel and that there's the perception of some to this day that it was meant to be prescient. I always thought it was a successor though not a direct sequel to "Animal Farm." In Animal Farm we saw how a dictatorship takes over and subdues. In "1984" we see what life is like years later. Whether it was intended to be predictive or not it very much has been. Right down to people putting Alexa in their homes so they can be listened in on. The President is a fink. |
