Somehow I’ve made it 65 years without being detained. Hmmmmm……. Maybe I was? You tell me…. I witnessed a guy having a seizure on the street and went to help. Cop saw me rifling through his wallet looking for a Med-alert card. Pulled gun on me until I explained who I was and what I was doing. I DEFINITELY was detained for a minute or so. I guess I was also detained when a cop pulled me over for speeding when I was on way to hospital to help in a life or death emergency. He wisely just took my word for it, and let me go so ’detained’ for a minute or so. Couple of other traffic infractions that I was probably detained 10 minutes or so while officer checked my license and wrote me a ticket. Seemed reasonable. I guess I’m not worried about being detained and arrested. If I was here ILLEGALLY, I guess I would be. By definition, EVERY SECOND they are here they are committing a crime. That’s why they are called ILLEGAL aliens. Not the euphemism ’undocumented visitor’ My hypothetical was not just a cop seeing a dark skinned guy on the street. It started with a citizen reporting what the citizen believed to be a crime. The crime being someone who came into the country illegally. That criminal does not need to be committing a second crime to make his mere presence here CRIMINAL. |

And you can tell just by looking at a fella whether they are present in the US legally or not? Rifling through a dude's a wallet while he's having a seizure is reasonable suspicion that you may be committing a crime. Getting pulled over for the observed traffic offense of speeding or whatever and getting a ticket or the cop letting you go to help with the medical emergency is also reasonable. I am willing to bet you are not worried about being detained or arrested because you, like me (a) do your best to live on this side of the law and (b)the civil rights and due process protections afforded to all of us. |

Of course not, but that is why you profile people. How are they dressed? How do they look? Do they speak English as if it is their first language? Are they loitering in the lot of THD looking for day work? All of these are what a detective would call "clues." There was an episode of "NYPD Blue" where Sipowictz is teaching his son about being a cop. He explains how you look at the scene and think of who belongs and who does not. Why are a couple guys just standing on the corner with no apparent purpose or reason? That kind of thing. Then you watch who looks like they need to be watched. Then you take action as needed. There has just been an unwitnessed shooting. You arrive at the scene. You see two people leaving the scene. You only have the ability to detain one. Candidate 1 looks remarkably like Nancy Pelosi. Candidate 2 is loaded with gang tattoos. Do I just flip a coin as to who to detain or can I use COMMON SENSE? (And you know I’m no fan of Nancy Pelosi) But seriously, ask yourself WHY profiling exists? Is it because cops are racist thugs…. Or is it because they want to be SUCCESSFUL in arresting criminals? The way you answer those two questions can often differentiate your political persuasion. |

I do not discount racist motivations in some police officers and some police forces. If I;m an out of shape cop, cuffing and stuffing the Pelosi look-alike might be easier. Let's assume that illegal immigrants are subject to arrest and deportation. That's a safe assumption because they are. The means under which that occurs matters. In the US the process matters. That's why it's called "due process". It's the same process that prevents the cops from stopping your car without evidence of a traffic offense or any other crime and detaining you and searching your car for contraband. It's the same process that prevents cops from stopping pedestrians searching them and demanding ID without reasonable suspicion of criminality. That process means get a frigging warrant if the cops want to arrest someone. Cops want to be successful in arresting criminals. We want cops to be successful in arresting criminal. But the end does not justify the means if those means are a violation of our civil rights. Plenty of evidence has been thrown out of cases for such violations. Prosecutions have been dropped or overturned for such violations. |

The show might be fictional, but the advice is correct. If you want to say why any of that is not good police work then we can have a discussion. Can you say what part of Andy's advice is not correct? And why? War is peace. Freedom is slavery. Ignorance is strength |
