You were correct.
He should not appear to be speaking unilaterally even if it about some totally extraneous matter.
He should have announced a desire to speak to the Opposing Counsel when you were present and announced in open court that it was on a different subject, thus giving you an opportunity to be aware of and heard on the issue.

Its like losing a golfing bet and putting the cash in a little white envelope and handing it to the judge in the courthouse... its the appearance of impropriety that is over riding.

Exactly - and this has happened a couple of times - with the attorney even making certain comments "off the record" about being friends with the Judge

I guarantee he will refuse to recuse and I will have to spend time on an appeal

Unless it's a one-horse town where everyone knows everyone else, I don't think a lawyer should argue before a judge he's friends with.

There is nothing wrong with appearing before a judge who is a friend any more than there is something wrong with arguing FOR a certain statutory interpretation in the morning and AGAINST the exact same statutory interpretation in the afternoon.

Especially since there is still a sign behind the Judge's bench that says "In God We Trust" (although I have made it into an anagram which sounds like a soap opera character's name "Ingo D. Wetrust" - a hardened silver miner from parts unknown who just rolled into town and is eyeing the local mob bosses gal)

They claimed to have been talking about a legal seminar they were going to attend. If that was the case, then why not include me - I like to learn new things too!
