re: the NY co-ed who claims she got raped:

https://www.yahoo.com/news/us/articles/know-lawsuit-investigation-alleged-gang-080029794.html

Reminds me of what I witnessed during my college days.

As a freshman I was "rushed" by several fraternities, and one of them prided themselves on offering "free pussy" for brothers and rushees.

It seems one of the frat brothers had met a "townie" chick who simply loved to fuck as many men as possible, so they "accomodated" her regularly.

I'm not saying that the co-ed in NY was as willing, just saying so-called "gang rapes" can be consensual.

I am not sure I fully follow the story and allegations , so I am going to avoid a firm opinion.

But, this seems very much like a drunken/drugged party accusation. You are talking about a situation from 2 years ago where everyone was certainly blasted, and getting into a he said / she said with zero hard evidence (as far as I can tell?) I am not sure that a definitive conclusion could ever be reached?

I wish her well, and I hope they get it worked out. But, I really am pretty lost on what else to think.

In modern times, if the girl gets drunk or high, even if she is the one who made that happen, a case can be made that she did not give legal consent. In this case there is a claim the bros were the ones who 'got her drunk and high' or some language to that effect, so they are really in trouble, in these days.

I was aware in my day of what seemed a very consensual multi-party copulation, drunken I think, but not direct witness. Today the incident might not be dismissed as consensual that readily. Did not participate. I was also involved in a drunken girl situation where the decision was made to decline the offer from someone just too far gone ... multi-party gave me great pause to begin with. Of course a case of me and more than one woman might be a temptation, the likes of which don't come around though. ha.

I believe she'd been drinking quite a bit before she went to the frat house so it isn't like she was forced to drink.

I suspect she also voluntarily partook in snorting ketamine.

Here is a link to a summary which should get you up to speed on the matter:

I’m not interested enough to spend time reading the alleged details. Just the claims (almost) never overcome the high bar of reasonable doubt. But the accuse are (virtually) always stained for life.

Put aside this case for a moment, general legal/philosophical question(s):

Can anyone (regardless of gender) consent to sex while drunk? Any amount of alcohol or certain limits (like driving?) And, what if both parties are equally drunk, and there was no nonconsensual aspects other than being drunk?
--------

It would be hard to find somebody who is more strict about consent than me. But, if you choose to drink alcohol and/or do drugs, you made an adult choice. Other adult choices you make (again assuming you consent in the moment,) are on you. I have done endless things I regret while drunk that I agreed to in the moment, that is on me...

Define "drunk."

It's a moving target.

Back when I started practicing law I'd get guys off on DWI charges when they blew .14 as the limit was .15.

When I quit practicing the limit was .08.

So if she was hypothetically at .12 when the incident happened she would not have been legally drunk 45 years ago but would be considered snockered today.

Does not compute.

But to answer the question: hell yeah she can consent while drunk: for example lots of night clubbers are hammered then screw strangers til the cows come home.

I dare say at least half of the participants in sexual intercourse have likely consumed some mind altering substance prior to sex, be it alcohol or drugs.

Wicked world.

That is the point. It is hard to define. Is it based on BAC purely, or is it based on personal ability/perception. BAC limits may make sense for driving and workplaces because they need a fixed limit. But, do they make sense for defining if somebody is able to consent to sex at a private party?

my wife surprised me by declaring that it was totally wrong for the guys involved to have all their pictures plastered all over the media
