I am never in favor of violating due process and the 4th Amendment, which is what torture does. Torture has never been a reliable means of collecting information, makes confessions unreliable and untruthful and cops never know where the line is, and always want to push the limits of what they can get away with. Torture at Guantanamo Bay after 9-11 didn't make us any safer, and didn't get any of the suspects any closer to justice.

So back to you:

Scenario #1: A person is taken in to custody on suspicion of kidnapping and he confesses to kidnapping a kid who will be fed alive to some fell beast. So we beat a confession and location of his liar out of him and rescue said bonnie lad. But the courts drop all criminal charges due to the 4th Amendment and due process violations. We save the kid, but the kidnapper walks free.

Scenario #2: A person is taken in to custody on suspicion of kidnapping and he confesses to kidnapping a kid who will be fed alive to some fell beast. So we try to convince him, perhaps with reduced charges or prison sentence, to confess to the location of his liar, but to no avail. The fell beast feeds on the carcass of the poor lad. The kidnapper is convicted and given a life or perhaps a capital sentence.

Which would SooPoo prefer?


You didn’t fully read my hypothetical. He confessed to the crime before he was subject to ‘enhanced interrogation’. That should thus be admissible and lead to his conviction. So I’ll go with your scenario 1, but expect a conviction from the evidence available before they beat the location out of him.

I liked Rx’s honest answer. I’m selfish just like he is. I want my child saved from the hyenas more than I care about ANYTHING that might happen to his abductor, due process or not.

In a similar vein, my take on Israel’s ‘disproportionate’ response to the slaughter, rape, torture, and kidnapping of its citizens is similar. The bomb will kill 50 combatants (or those living in the same building as the held hostage) but clear a path to free A hostage… go for it. Let that hostage go free and no bomb to your building. Don’t be complicit in hiding the hostages and don’t be bombed.

Never heard of people coming to this country just to work and send money home? You get deported for being here illegally, not just trying to stay and get citizenship.

If you expect to be deported anyway, and not allowed to legally reapply, you don't have that option.

You are aware that courts have dismissed charges against people exposed to police brutality AFTER they have confessed, as violations of the 4th Amendment?

You haven't answered my questions, doc. What due process rights do you think should not apply to Garcia, or me when I was arrested, or Donny when he was brought up on criminal charges, or you when the cop held you at gunpoint when you were a good Samaritan? Inquiring minds want to k now!

Trump’s anti-illegal alien policy is as misguided as anything the Democrats could ever come up with. Had Trump just gone with mass removal of criminals it would make sense. Only a total idiot removes people who could be considered as a net plus, and border crossing by itself, is worth only a technical foul in such cases.

Then let’s have a policy where you can cross illegally but are ‘a net plus’ override the illegal crossing? Who decides what is a net plus? Is a woman who comes here with no intent on working but plans on having 8 children who will most likely be on some form of public assistance a net plus? Because her husband works hard at picking apples? I’ve been taken to task here about ‘due process’. There is a ‘due process’ to get into this country. Let’s follow it, and kick out those that don’t.
